Warranty Terms for Pammys Snowboots 3.0

1. Warranty Provider and Scope

The provider of the following voluntary warranties is dieseo GmbH, Gaardener Ring 11, 24143 Kiel, Germany (hereinafter “Pammys”). This is not a return address.

The warranties apply to new Pammys Snowboots 3.0 that are expressly marked on their product page at the time of purchase with the “100-Day Wear & Cold Protection Warranty” and the “12-Month Quality Warranty.” They apply to purchases by consumers via pammys.com with delivery to  all countries that can be selected as the delivery country during checkout. The delivery country stated in your order confirmation is decisive. The warranties apply regardless of which language or country version of pammys.com you use when purchasing.

The warranty periods begin for each pair upon delivery. Registration is not required. The order number or another suitable proof of purchase is sufficient as proof of purchase.

Our Snowboots 3.0 are designed for winter temperatures down to  −20 °C and are 100% waterproof under normal winter use. You can wear and test them outdoors in winter. If your feet get wet within 100 calendar days after delivery when wearing the Snowboots normally because water enters from outside, or if your feet do not stay warm in them at outdoor temperatures down to −20 °C, you may return the pair under this warranty and choose between the money-back benefit under Section 2.4 and a free replacement pair. For purchases with a multi-pair discount, the money-back benefit may be lower than the price originally shown for the returned pair because of the recalculation of the offer explained in Section 2.4. Either of the two reasons is sufficient for the warranty. You do not need to prove a material or manufacturing defect.

Normal winter use includes, in particular, commuting to work, walks, and walking through rain, snow, or slush. The warranty also applies to shoes worn outdoors with normal signs of use. You do not need to test them for a specific number of days or prove a measured outdoor temperature.

2.2 Limits of the Warranty Promise

Waterproofness refers to water entering through the shoe, including its material and seam connections. Liquid that enters the shoe from above through the shaft opening, as well as moisture caused exclusively by sweating, is not covered by the waterproofness promise. Cold protection is guaranteed for outdoor temperatures down to −20 °C.

The warranty does not apply if

  • the pair is not one of the Snowboots 3.0 mentioned in Section 1 or the purchase does not fall within the scope described there;
  • the wetness was caused exclusively by sweating or by water or snow entering the shoe from above through the shaft opening;
  • you are complaining solely because of cold feet and the use in question took place at temperatures below −20 °C;
  • the wetness or cold is exclusively attributable to intentional damage, unauthorized modification of the shoe, or obviously improper use; or
  • the warranty claim is made only after the 100-day period has expired.

These limitations do not affect your statutory rights in the event of defects.

2.3 Notification and Return

Contact us by email at hallo@pammys.com or via the contact form at https://pammys.com/pages/hilfe no later than the 100th calendar day after delivery. Explicitly refer to the “100-Day Wear & Cold Protection Warranty” in your message and tell us whether your feet became wet or cold. Provide your order number or include another suitable proof of purchase.

Include photos of the affected pair with your notification: at least one full view of both shoes, as well as photos of the outer sides and the inside of the shoes. In the case of wetness, also photograph the wet area if possible. The photos are used to identify and inspect the pair; they do not need to visibly show cold. We do not require proof from a thermometer. If information or photos are missing, we will ask you to provide them before deciding on the voluntary warranty benefit.

We will provide you with return instructions and a free return label. After receiving the label, send the complete pair to the address stated on it. The shoes’ original product packaging is required for returns under this voluntary warranty. The outer shipping box does not need to be the original box; another sturdy shipping box is sufficient. Normal signs of use do not exclude a return. Please remove heavy dirt and package the shoes dry. Do not send the shoes to our business address in Kiel.

2.4 Money-Back Benefit or Replacement Pair

If you choose your money back, after receiving the pair, we will refund, in the case of an individual purchase, the purchase price actually paid for that pair using the payment method used for the purchase. We will also refund the standard shipping costs originally paid if you ordered only this pair. The return under the warranty is free of charge for you. A voucher does not replace a cash refund.

For bundle offers , a price reduction may be linked to a minimum number of pairs, a minimum order value, or a specific combination of products. The requirements and prices stated for your offer at the time of ordering before purchase are decisive. If, under this voluntary warranty, you return only some of the pairs purchased in the bundle, we will recalculate the price of the products retained based on the original offer terms. If the minimum requirements of the bundle continue to be met with the retained products, the bundle discount provided for them will apply. If they are no longer met, that discount will no longer apply. Discounts provided at the time of purchase for the first or only pair remain applicable to a retained pair, even if it was originally discounted as the second pair. Other discounts actually used when ordering remain applicable insofar as their requirements continue to be met with the retained products. Subsequent price or discount changes will not be taken into account. We will refund the difference between the price actually paid for the products covered by the bundle and the newly recalculated price of the retained products.

For other promotions without bundle requirements , we will refund the portion of the price actually paid for the products attributable to the returned pair. A discount assigned to a specific pair at the time of purchase will be allocated to that pair. A shared discount will be distributed in proportion to the individual prices of the discounted products before the discount.

If you choose a free replacement pair , after returning the affected pair, you will receive the same model in the same size and color, subject to availability. You will receive a different version only with your consent. If no suitable replacement pair is available and you do not want a different version, you are entitled to the money-back benefit under the rules above. For a replacement pair, the purchase price of the retained pair will not be recalculated. The original 100-day period for this voluntary warranty does not restart upon delivery of the replacement. Your statutory rights remain unaffected.

3. 12-Month Quality Warranty

3.1 Warranty Promise

If, during 12 months after delivery under normal use, the sole of a Snowboot 3.0 comes detached from the shoe or a seam on the shoe tears, you will receive a free replacement pair under this warranty. It is sufficient for one of these problems to occur during the warranty period under normal use. You do not need to prove that its cause was already present upon delivery.

The replacement pair will correspond to the affected model, size, and color, subject to availability. You will receive a different size, color, or model only with your consent. If the corresponding pair is no longer available and you do not want another one, you will instead receive a money-back benefit: for an individual purchase, we will refund the purchase price actually paid for the affected pair; for a bundle or other discounted offer, the amount will be calculated under Section 2.4. We will inform you of this amount in advance. We will not require any additional payment for retained products. You will incur no costs for inspection or required shipping.

3.2 Limits of the Quality Warranty

The voluntary quality warranty does not apply if

  • the pair is not one of the Snowboots 3.0 mentioned in Section 1 or the purchase does not fall within the scope described there;
  • neither a sole has detached from the shoe nor a seam has torn; normal wear of the sole tread, superficial scratches, or individual loose threads without a torn seam do not, by themselves, constitute a case under this quality warranty;
  • the damage was caused exclusively by an accident, intentional damage, unauthorized modifications, improper care, or obviously improper use; or
  • the warranty claim is made only after the 12-month period has expired.

The fact that the pair has already been worn is not a reason to exclude a sole that detached or a seam that tore during normal use.

These limits apply only to the voluntary quality warranty. Your statutory rights regarding other defects remain in effect.

3.3 Notification and Replacement

Contact us within 12 months after delivery by email at hallo@pammys.com or via the contact form at https://pammys.com/pages/hilfe. Explicitly refer to the “12-Month Quality Warranty” in your message. State your order number or include another suitable proof of purchase and describe which sole has detached or which seam has torn.

Include photos: at least one full view of the affected pair, as well as clearly recognizable close-up photos of the detached sole or torn seam. If information or photos are missing, we will ask you to provide them before deciding on the voluntary warranty benefit. If an additional inspection of the shoes is required, we will send you instructions and a free return label. The shoes’ original product packaging is required for returns under this voluntary warranty; the outer shipping box may be another sturdy box. Do not send the shoes unsolicited to our business address in Kiel.

If a warranty case exists, we will send you the free replacement pair. A replacement delivered under this voluntary warranty generally does not change its original 12-month period. Your statutory rights regarding the original or replacement goods remain unaffected.

4. Statutory Rights

Within the first 100 days, if a situation is covered by both warranties, you may choose which voluntary warranty benefit you wish to claim. After a money-back benefit has been provided for a returned pair, no further benefit under these voluntary warranties may be claimed for the same pair.

Your statutory rights in the event of defects against the seller exist independently of these voluntary warranties. You may assert these rights free of charge. They are not limited by these warranty terms. In particular, the recalculation of a multi-pair offer under Section 2.4 does not apply to claims under statutory liability for defects. You may also rely on your statutory rights if the requirements of one of the voluntary warranties are not met or its period has expired. You do not need to designate your complaint as a warranty claim in order to assert statutory rights.
