Affiliate Program – Terms and Conditions

A. Overview

These terms and conditions (“Terms”) govern membership and participation in the affiliate and ambassador program of the Pammys Affiliate Club (hereinafter referred to as the “Provider”). By registering and participating in the program, you agree to these Terms bindingly.

Participation in the program is only permitted for natural persons who have reached the age of 18. By registering, you expressly confirm that you are of legal age. The Provider reserves the right to request appropriate proof of age.

The Provider is entitled to change these Terms at any time with effect for the future. Your continued participation in the program after a change is deemed acceptance of the adjusted Terms.

A violation of these Terms may lead to the immediate termination of your account. In this case, all unpaid commissions and all benefits associated with participation will be forfeited.

B. Your Referral Link and Commission

After successful admission to the program, you will receive an individual referral link and a personal discount code clearly assigned to you. These serve to track sales you have referred.

Commissions are granted exclusively for sales generated through your personal link or discount code and for which payment has been fully completed. The entitlement to commission lapses in particular if orders are canceled, revoked, or reversed for other reasons.

The exact amount of the commission and the payment modalities are determined by the Provider and may be adjusted at any time. There is no entitlement to the unchanged continuation of specific commission models.

C. Permitted Use

You commit to prominently displaying your personal discount code in the bio or profile description of your used social media channels, provided the respective platform technically allows this. The goal is a clear and transparent assignment of your referral link and discount code.

The use must always be transparent, truthful, and in accordance with applicable legal regulations. In particular, you are obliged to properly label advertising content and not to make misleading statements.

The responsibility for the distribution, use, and control of your own discount code and personal referral link lies solely with the respective affiliate partner. The Provider assumes no liability for misuse, unauthorized disclosure, or incorrect distribution of the code by third parties.

The affiliate is obliged to take appropriate measures to prevent misuse of their discount code. Should the Provider detect misuse or suspect abusive use, it reserves the right to temporarily block or permanently deactivate the respective discount code or affiliate account at any time.

D. Binding Activity Obligation and Product Conditions

By participating in the affiliate or ambassador program, the affiliate commits to publishing at least four (4) independent posts on the agreed social media platforms after receiving the provided products. Posts include, in particular, videos, reels, TikToks, feed posts, or comparable content that clearly promote the Provider or its products.

The content must be published within a reasonable period after receiving the products and meet the program’s requirements. The Provider reserves the right to reject content if it does not meet quality or brand guidelines.

If the affiliate does not fulfill this obligation and publishes fewer than four posts, the Provider is entitled to fully charge the provided products, especially shoes or other sent items. The affiliate expressly agrees to bear the corresponding costs in this case.

The invoice amount is based on the regular retail price of the respective products at the time of calculation.

E. Prohibited Use

It is expressly prohibited to use original content of the Provider or content from other creators for your own purposes or to present it as your own content without prior express permission.

It is also not permitted to distribute your personal referral link or discount code on publicly accessible coupon, deal, or aggregator websites. This includes platforms such as Reddit, Google search result pages, coupon portals, or comparable offer sites.

The use of paid advertisements, especially via platforms like Google Ads, on the Provider’s brand terms is prohibited. This applies regardless of whether the advertisement directly or indirectly refers to your referral link.

Furthermore, it is prohibited to place your referral link or discount code on official social media profiles of the Provider or in posts, comments, or content of other creators.

Any form of disparagement or negative portrayal of the Provider’s products, content, employees, or business practices is prohibited. Likewise, inappropriate language or references to controversial or sensitive topics that could harm the Provider’s reputation must not be used in connection with promotion.

It is also prohibited to contact moderators or support centers of the Provider regarding individual orders, especially those generated through your referral link. Employees or representatives of the Provider must not be contacted via their private social media accounts.

Requests about internal processes, especially regarding product releases, restocking, or other non-publicly communicated information, are also not permitted.

A violation of these provisions will result in the immediate termination of your participation in the program. In this case, your account will be blocked and all unpaid commissions will be forfeited without replacement.

The Provider reserves the right to change or expand these regulations at any time. Your continued participation is deemed acceptance of the amended Terms.

F. Representations & Warranties

By participating, you confirm that all information you provide is truthful and complete. You commit not to publish content that violates applicable law or infringes the rights of third parties.

You warrant that you will not make misleading or false statements about the Provider’s products or services and will comply with all legal requirements, especially in the areas of competition law, data protection, and advertising labeling.

G. Term

Participation in the affiliate program is for an indefinite period. Both parties have the right to terminate participation at any time.

The Provider is entitled to block or terminate your account at any time without giving reasons. In case of termination due to a violation of these Terms, there is no entitlement to payment of any outstanding commissions.

H. Confidential Information

All information provided to you within the program that is not publicly accessible is considered confidential. You agree not to disclose this information to third parties or use it for purposes other than participation in the program.

I. Indemnification

You agree to indemnify the Provider against all third-party claims arising from your conduct in connection with participation in the program. This applies in particular to violations of legal regulations, third-party rights, or these Terms.

J. No Publicity

You are not authorized to act on behalf of the company or create the impression that you are an official representative or employee of the Provider without prior express written consent.

K. Non-Disparagement

You agree not to make statements or distribute content that could damage the reputation or image of the Provider. This applies both during participation in the program and after its termination.

L. Miscellaneous

You act as an independent affiliate within this program and not as an employee or representative of the Provider. You are solely responsible for properly taxing your income.

The law of the Federal Republic of Germany applies. Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
