General Terms and Conditions

1. Scope

The following terms and conditions apply to all orders via our online shop. Our online shop is exclusively aimed at consumers.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities. An entrepreneur is a natural or legal person or a legally capable partnership who acts in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.

2. Contract partner, conclusion of contract, correction options

The purchase contract is concluded with dieseo GmbH.

By listing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.

3. Contract language, contract text storage

The language(s) available for concluding the contract: German

We save the contract text and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the internet.

4. Delivery conditions

Shipping costs are added to the stated product prices. Details about the amount of shipping costs can be found in the offers or in the shipping information.

We only deliver by shipping. Unfortunately, self-collection of the goods is not possible.

The delivery time is specified separately for each item on the product page.

If the delivery time is not specified, our general delivery times apply, which you can find in the Shipping information.

Please note that we are exceptionally not obliged to deliver the ordered goods if we have properly ordered the goods ourselves but have not been supplied correctly or on time (congruent cover transaction). Furthermore, we are not allowed to assume the risk of procuring the ordered goods.

If the tracking information indicates that your shipment was delivered but you have not received the goods, please contact us within three days of the stated delivery date. This deadline must be observed to take further steps. More information is explained in our FAQs.

If your order cannot be delivered multiple times for reasons beyond our control, is refused, or the shipment is not picked up from the parcel station/branch, it will be returned to us. In these cases, this is equivalent to a withdrawal. This automatically converts the contract into a reversal relationship. We will refund the paid items, minus any additional costs incurred (e.g., shipping €4.00 to €6.90).

5. Payment

The following payment methods are generally available in our shop:

Credit card
During the ordering process, you provide your credit card details. Your card will be charged immediately after placing the order.

PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate with your login credentials, and confirm the payment instruction. The payment transaction will be processed by PayPal immediately after placing the order. Further information is provided during the ordering process.

Sofort by klarna
To pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have a bank account enabled for online banking, authenticate accordingly, and confirm the payment instruction. Your account will be charged immediately after placing the order. Further information is provided during the ordering process.

Google Pay
To pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have Google Pay enabled, authenticate with your login credentials, and confirm the payment instruction. The payment transaction will be processed immediately after placing the order. Further information is provided during the ordering process.

Apple Pay
To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the Safari browser, be registered with Apple, have Apple Pay enabled, authenticate with your login credentials, and confirm the payment instruction. The payment transaction will be processed immediately after placing the order. Further information is provided during the ordering process.

Amazon Pay
To pay the invoice amount via the payment service provider Amazon Payments Europe S.C.A., 38 avenue J.F. Kennedy, L-1855 Luxembourg ("Amazon"), you must be registered with Amazon, authenticate yourself with your login data, and confirm the payment instruction. The payment transaction will be carried out within one banking business day after placing the order. A banking business day is any weekday except Saturdays, nationwide public holidays, and December 24 and 31 of each year. Further information is provided during the ordering process.

Klarna
In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer you the following payment options. Payment via Klarna is only available to consumers. Unless otherwise regulated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Further information is provided with each payment option and during the ordering process.

Purchase on Invoice via Klarna

The invoice amount is due 14 days after shipment of the goods and receipt of the invoice.

Klarna Credit Card

During the ordering process, you provide your credit card details. Your card will be charged by Klarna immediately after placing the order. No address or credit check is performed.

6. Retention of Title

The goods remain our property until full payment is made.

7. Warranty and Guarantees

Applicability of the statutory warranty law

Unless expressly agreed otherwise below, the statutory warranty law applies.
The following limitations and time reductions do not apply to claims due to damages caused by us, our legal representatives, or vicarious agents

  • in case of injury to life, body, or health
  • in case of intentional or grossly negligent breach of duty as well as fraud
  • in case of breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on which the contracting party may regularly rely (cardinal obligations)
  • within the scope of a warranty promise, as agreed, or
  • as far as the scope of the Product Liability Act applies.

Restrictions for Consumers

When purchasing used goods by consumers, the following applies: if the defect occurs after one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year from delivery of the goods can be asserted within the statutory limitation period of two years from delivery of the goods.

Warranties and Customer Service

Information on any applicable additional warranties and their exact conditions can be found with the product and on special information pages in the online shop.

8. Liability

For claims due to damages caused by us, our legal representatives, or vicarious agents, we are always liable without limitation

  • in case of injury to life, body, or health,
  • in case of intentional or grossly negligent breach of duty,
  • in case of warranty promises, if agreed, or
  • as far as the scope of the Product Liability Act applies.

In the event of a breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on which the contracting party regularly relies (cardinal obligations), caused by slight negligence on our part, our legal representatives, or vicarious agents, liability is limited in amount to the foreseeable damage at the time of contract conclusion, which typically must be expected.
Claims for damages are otherwise excluded.

9. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

10. Complaint / Wrong Delivery

If you have received a damaged, wrong, or incomplete item (incorrect delivery), please contact us within three days of the stated delivery date. Prior contact is necessary for a return. This deadline must be met so that we can take further steps.

11. Transport Damage

If you receive goods with obvious transport damage, please report these defects immediately to the delivery person, document the defects with photos, and contact us within three days. Missing the deadline means we cannot claim the defects with the shipping service provider and you will not be reimbursed. More details about the process can be found in our FAQs.

12. Gift Vouchers

A correct email address is required for sending the gift voucher. 

We accept no liability for loss of the gift voucher. 

The Pammys™ voucher can be used until fully redeemed, and the balance will neither be paid out nor accrue interest. 

When returning goods purchased with the gift voucher, the purchase price will be credited to the voucher.

By purchasing and/or using the gift voucher, you agree to the terms of use provided to you at the time of purchase.

13. Discount codes

The corresponding discount code can be applied once per customer to one purchase.

Each discount code can only be used once per customer for one purchase, and discount codes cannot be combined. Only one discount code can be used per order.

It is not possible to apply a discount code retroactively to an already completed order. 

In the case of a return or withdrawal, only the reduced purchase price will be refunded. There is no entitlement to a refund of the discount code or the issuance of a new discount code.

14. Gift code

A correct email address is required to send the gift code.

The Pammys™ gift code can be redeemed once and can only be used for purchases in our online shop. Cash payment, interest, or subsequent changes to the code are excluded.

If the value of the gift code is not fully used upon redemption, the remaining balance will expire. Partial payment or credit of the remaining value is not possible.

Once a customer explicitly chooses a gift code as part of a return, a subsequent change of this decision is excluded. In particular, a refund to the originally used payment method is no longer possible. Instead, a new gift code will be issued for the value of the returned goods.

The gift code cannot be combined with other discounts, promotions, or promo codes.

By choosing and redeeming the gift code, you accept these terms and our General Terms and Conditions bindingly.

15. Right of withdrawal

You can find information about the right of withdrawal here.

If worn, damaged, or items not originating from the customer are received and the return is rejected, the customer has 7 days to respond to the rejection email. Through a link in the rejection email, the customer has the option to upload a shipping label within 7 days, with which the rejected items can be returned. If no response or label is received within this period, the items will be donated.
